This website is owned and operated by G Dale Designs Ltd T/As. Snap Dragon Guitars. 10 Eckersly Road Industrial Estate, Chelmsford, Essex, CM1 1SL.  As a user of this website you acknowledge that any use of this website’s contents, and any transaction carried out via it, is subject to our terms and conditions:

  1. General

 

  1. We reserve the right to change these terms and conditions at any time. Any such changes will take effect when posted on the website.
  2. It is your responsibility to read the terms and conditions, entering into a transaction with  Robert Hunt T/As. Snap Dragon Guitars, will signify your acceptance to be bound by our current terms and conditions.  These are the only terms on which Snap Dragon products may be purchased, offered or provided.  Any attempt by the customer to use its own terms and conditions of purchase shall be void.
  3. These terms and conditions will apply to all transactions placed online, by e-mail, telephone or by post. Please read the terms and conditions carefully before placing any order. All transactions with G Dale Designs Ltd T/As. Snap Dragon Guitars, 10 Eckersly Road Industrial Estate, Chelmsford, Essex, CM1 1SL will be governed by these terms and conditions.
  4. Failure or delay by G Dale Designs Ltd T/As. Snap Dragon Guitars 10 Eckersly Road Industrial Estate, Chelmsford, Essex, CM1 1SL in enforcing or partially enforcing any provision of terms and conditions shall not be construed as a waiver of any rights.

  1. All references to the ‘company,’ ‘us,’ ‘our,’ ‘we’ or ‘Snap Dragon Guitars’ means G Dale Designs Ltd T/As. Snap Dragon Guitars 10 Eckersly Road Industrial Estate, Chelmsford, Essex, CM1 1SL
  2. All references to ‘you,’ ‘your,’ the ‘user’ or the ‘customer’ mean the person or persons, using the website, making a transaction such as a donation or purchasing goods or agreeing to purchase goods, from G Dale Designs Ltd T/As. Snap Dragon Guitars 10 Eckersly Road Industrial Estate, Chelmsford, Essex, CM1 1SL
  3. All references to the ‘Website’ shall include reference to all URL’s owned by Robert Hunt
  4. ‘Business Day’ means a day other than a public holiday, a Saturday or a Sunday on which commercial banks are open for general business in London, England.
  5. ‘Transaction’ means any donation made by, or contract to purchase goods entered into by, a user of the website with G Dale Designs Ltd T/As. Snap Dragon Guitars, 10 Eckersly Road Industrial Estate, Chelmsford, Essex, CM1 1SL
  6. ‘Communications’ includes communication by telephone, fax, email, mobile phone text message and postal or courier service.
  7. ‘Deemed day of receipt’ can only be on a business day and means, in the case of telephone communications the time and day of the connected call between Snap Dragon and you, in the case of fax at the point of the sender’s time and date stamp if between 9 am and 5 pm on the UK’s time zone and if outside those hours at 9 am on the following business day, in the case of email at the point of the sender’s time and date stamp if between 9 am and 5 pm on the UK’s time zone and if outside those hours at 9 am on the following business day, in the case of mobile phone text message at the point of the sender’s time and date stamp if between 9 am and 5 pm on the UK’s time zone and if outside those hours at 9 am on the following business day, in the case of postal service two business days after the proven date of posting, and in the case of courier deliveries at the time and on the date recorded when the communication was signed for.
  8. ‘Goods’ or ‘Products’ means goods purchased by you from G Dale Designs Ltd T/As. Snap Dragon Guitars, 10 Eckersly Road Industrial Estate, Chelmsford, Essex, CM1 1SL

 

  1. Jurisdiction, Territorial Limitations & Severability

 

  1. All transactions shall be governed by and construed in accordance with English Law and any dispute between the user and G Dale Designs Ltd T/As. Snap Dragon Guitars, 10 Eckersly Road Industrial Estate, Chelmsford, Essex, CM1 1SL. will be resolved exclusively in the courts of England and Wales. Nothing in these terms and conditions will be deemed to affect your statutory rights under English law.
  2. If any part of these terms and conditions is held by any court of England and Wales to be invalid or unenforceable in whole or in part, the validity or enforceability of the other sections of these terms and conditions shall not be affected.

 

  1. Order processing, pricing, point & time of contract

 

  1. Orders - We are pleased to accept orders by any of the following methods: Online transaction (secure server),e-mail (unsecure),telephone, post or fax. All credit / debit card transactions are subject to validation checks and are authorised by the card issuer. We accept MasterCard, Visa, Delta, Maestro and Solo. If the issuer of your card refuses to authorise payment to us, we will not be liable for any delay and / or non-delivery of your order. No orders will be accepted or processed without a valid card payment in the name of the registered cardholder.
  2. No Order shall be deemed to be accepted until a written acceptance of the Order is issued by us or (if earlier) we commence fulfilment of the Order in whole or in part.
  3. All prices are shown in pounds sterling (£) and are inclusive of UK Value Added Tax (‘VAT’). VAT will be charged at the prevailing rate unless clearly stated otherwise.  All prices are subject to change without prior notice.
  4. Pricing and Print Errors - Prices and specifications are checked to the best of our ability, and whilst every effort has been made to make them accurate, no responsibility will be accepted for errors and omissions. We reserve the right to alter our prices and specifications without notice.
  5. A transaction is concluded and creates a time of contract when we receive your cleared funds for purchase being made.  All contracts occur at the place of processing which is at G Dale Designs Ltd T/As. Snap Dragon Guitars. 10 Eckersly Road Industrial Estate, Chelmsford, Essex, CM1 1SL.

 

  1. Payment terms and title to goods

 

  1. Ownership of Goods - All items supplied to the customer remain the property of Robert Hunt. until final payment of all sums owing in respect of those goods has been received in full by us. We shall not be deemed to have received any payments until cleared funds are received.  Upon full payment we will despatch the goods to you and the title to those goods passes to you upon delivery.
  2. In accordance with our Privacy Policy Terms & Conditions and to ensure that your credit, debit, charge card or PayPal account is not being used without your consent, we will validate name, address and other personal information supplied by you during the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.
  3. The Price is exclusive of any applicable sales taxes, any other charges (including bank charges),taxes and import and export duties, all of which the customer shall pay in addition when it is due to pay for the goods.
  4. You can change or cancel an order prior to it being despatched, by contacting us by e-mail at admin@snap-dragon-guitars.co.uk or calling us on +44 (0) 1277 364449 Monday to Friday between 9:00 a.m. and 5:30 p.m. please have the order number and date the order was placed to hand, subject to clause 15.

 

  1. Delivery Terms

 

  1. Every effort is made to ensure that delivery is made within the estimated time scales and within a maximum of 30 business days. If for any reason we cannot do this we will get in touch to let you know what is happening within 21 business days of your transaction with us. If there is a problem with the availability of your chosen goods our customer services staff will let you know the likely delivery date within 28 business days of your transaction with us. Please allow additional time (details on request) for the delivery of special order items.
  2. Time for delivery shall not be of the essence unless previously agreed by us in writing, and we reserve the right at our sole discretion to make partial deliveries of the ordered goods.
  3. Goods will not be left without a signature confirming receipt. Please provide us with a delivery address where the parcel can be signed for between the hours of 8:00am and 5:30pm on your time zone. All goods must be signed for by an adult aged 18 years on delivery. If you are out when our couriers call they will leave a card with contact details and you can phone to arrange a convenient time for redelivery.
  4. If you have any delivery queries, please call our customer service centre on +44 (0) 1277 364449 Items ordered will be delivered as soon as possible in accordance with the requested delivery service. Charges for the different delivery services can be obtained from our Customer Service Department.
  5. All delivery charges are subject to change without prior notice.
  6. In the event of any goods delivered by us being, damaged in transit, orders deficient of items shown on the delivery note, or failing to match the items ordered by you, then such details must be notified by you to us within seven business days of receipt in order to make any claim for compensation or replacements from us under our warranty see clause 8. If we receive no such notification the customer will be deemed to have accepted the items as satisfactory and as a complete delivery in full consideration of the transaction.
  7. We cannot be held liable for any consequential loss caused by late delivery or failure to deliver by the company’s appointed carrier. Liability in such cases is limited to the value of those items, which are shown not to have been received by the customer.
  8. Goods will only be despatched to the cardholder address of the card used for payment of Products. Any redirection of an order after despatch may incur extra charges.
  9. If your order does not arrive by the date it is due, or arrives incomplete or damaged, please contact us by e-mail to admin@snap-dragon-guitars.co.uk or calling us on +44 (0) 1277 364449 Monday to Friday between 9:00 a.m. and 5:30 p.m. UK time.

 

  1. Customer Feedback, Compliments & Complaints

 

  1. Up to 3 months after receiving your goods we may send you a communication inviting you to review your purchased goods or our customer service, such communications shall comply with our Privacy Policy Terms & Conditions.
  2. Any complaint or compliment can be sent to our Customer Service Department. We will endeavour to deal with your complaint within five business days of the deemed day of receipt. In the event where we cannot resolve your complaint immediately we will advise you within 14 business days of the steps we will undertake and the likely timescale of those steps, keeping you informed of any investigation we conduct into your compliant, so far as we are permitted to do so by the laws of England.

 

  1. Warranty & Returns Policy

 

  1. Our products come with a 1 year warranty from the date of the transaction as defined in clause 4 against defects in materials and workmanship.  We will at our sole discretion repair or replace the damaged item(s). This warranty excludes faults caused by accident, neglect or misuse.
  2. This warranty does not affect your statutory legal rights under English law.
  3. If you purchased products directly from our website or by mail order you will need to contact our customer services department for a Return.  We will only accept returns where the defect is notified to us within 14 business days of delivery.  Once we have been notified, and the customer provided a Returns label, the item must then be returned within 28 business days.  Please include a note clearly indicating the defect.  Products returned without our prior authorization may be rejected if the Products are not eligible for return.
  4. It is advisable to check your order before accepting delivery. We cannot accept claims for goods damaged in transit if the goods have been accepted from the courier and damage is not notified to us within 5 business days. 
  5. We will exchange the item or refund the full cost, including any delivery charges incurred, at our absolute discretion in accordance with our warranty policy.
  6. When returning faulty goods be aware that any refunds or exchanges may take up to 14 business days.
  7. We recommend that all items be returned either by the return label provided.  We advise you to make a note of the tracking number, and to provide your contact details on the reverse of package used to return goods. We cannot accept any responsibility for goods not received by us.
  8. You shall be responsible for all costs of carriage including, telephone, postal and all other costs incidental or otherwise incurred in returning any Products you have purchased from us, except where Products received by you are damaged or faulty condition.
  9. You are responsible for the Products and any loss or damage until they are received by us. The onus of proof is with you to prove safe delivery to us.
  10. If a credit is given where undamaged goods are returned to us the return carriage charge will not be refunded.
  11. Products returned as faulty that are found to be in good order with no defects may incur a service charge payable by you. Certain software items are not eligible for return if opened and/or registered. Guitar setup or initial configuration/setup on some electronic devices are not considered to be a fault.
  12. If you are returning a product from outside the UK, you will not receive a refund for any customs duty, import tax or service fee charged by the courier for the delivery of your order. You can reclaim any tax paid by contacting the carrier or local authority with proof of tax paid.

  1. Refunds

 

  1. We hope you'll be pleased with your purchase. If you should change your mind, and wish to return a Product, we will be happy to refund or exchange a Product providing it is in fully re-saleable condition and returned within 28 business days of you receiving the Product.
  2. If the Product returned is not in fully re-saleable original condition, or not its original packaging, or the packaging is damaged, all such conditions being a judgment of us solely at our discretion, then we do reserve the right to refuse a refund on the item or to deduct up to 20% of the original selling price from the refund amount. 
  3. Refunds can only be made to the original card of purchase.
  4. Refunds do not include any customs duty, import tax or service fee charged by the courier for the delivery of your order. 

 

  1. Limitations on Liability & Indemnity

 

  1. Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation, or any other liability which may not otherwise be limited or excluded under English law.
  2. We will use reasonable endeavours to verify the accuracy of any information on the website but we make no representation or warranty of any kind, express or implied, statutory or otherwise, regarding the contents the website.
  3. We make no warranty that the website or the server that makes it available, are free of viruses, or that its content are accurate.  We will not be responsible or liable to you for any loss of any kind, from action taken, or taken in reliance on material, or information, contained on the website.
  4. Except for the Warranty provided in clause 8 any other indemnities, warranties, terms and conditions (whether express or implied) are hereby excluded to the fullest extent permitted under English law.
  5. Our employees or agents are not authorised to make any representations or warranties concerning our Products including but without prejudice to the generality of the foregoing the quality of the Products fitness of the Products for a particular purpose of the customer or their compatibility with any other products unless (a) confirmed in writing in a contract or (b) agreed between the parties in writing by way of variation of a contract and these terms and conditions.  In entering into a transaction with us the customer acknowledges that it does not rely on, and waives any claim for breach of, any such representations which are not so confirmed.
  6. Any advice or recommendation given by us. or our employees or agents to the customer or its employees or agents as to the storage or use of our Products, which is not (a) confirmed in writing in a contract or (b) agreed between the parties in writing by way of variation of a contract and these terms and conditions is followed or acted upon entirely at the customers own risk and accordingly we shall not be liable for any such advice or recommendation which is not so confirmed.
  7. We will not be liable, in contract, or tort (including, without limitation, negligence),other than where we have been fraudulent or made negligent misrepresentations.
  8. Notwithstanding the above, our aggregate liability (whether in contract, tort or otherwise) for loss or damage shall, in any event, be limited to a sum equal to the amount paid, or payable by you, for the goods purchased from us by a transaction.
  9. This clause does not affect your statutory rights as a consumer, nor does it affect your contract cancellation rights, under English law.
  10. In accordance with our Privacy Policy Terms & Conditions we will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you to us.

 

  1. Description of Products/Availability

Each Product purchased is sold subject to its Product Description which sets out additional Specific Conditions related to that Product including, without limitation, terms and conditions concerning when the Product will be in Stock, estimated delivery dates and times, warranties, after-sales service and guarantees.  We will take all reasonable care to ensure that all details, descriptions and prices of Products appearing on the Website are correct at the time when the relevant information was entered into the system. All prices are shown in United Kingdom Pounds Sterling and include Value Added Tax (VAT) at the current rate, please satisfy yourself whether the price shown includes applicable taxes. Although we aim to keep the Website as up to date, the information including Product Descriptions appearing on this Website at a particular time may not always reflect the position exactly at the moment you place an order.


 

  1. Force Majeure

We shall not be liable or be deemed to be in breach of contract by reason of any delay in performing or failure to perform any of our obligations where such delay or failure is due to any cause beyond our reasonable control, and in such circumstances we shall be entitled to a reasonable extension of time for performing such obligations.  Without prejudice to the generality of the foregoing, the following shall be regarded as causes beyond our reasonable control; Act of God, explosion, flood, tempest, fire or accident; war or threat of war, sabotage, insurrection, civil disturbance or requisition; acts, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority; import or export regulations or embargoes; strikes, lock-outs or other industrial actions or trade disputes (whether involving our employees or a third party); difficulties in obtaining raw materials, labour, fuel, parts or machinery; power failure or breakdown in machinery, material breach of contract or other default of our suppliers or sub-contractors. If by reason of such circumstances it shall become impossible within a reasonable time for us to wholly or partly supply the items ordered then the customer’s liability will be limited to the value of the items already supplied together with any associated reasonable delivery charges.

  2. We endeavour to take all reasonable steps to protect your personal information. However, we cannot guarantee the security of any data you disclose online. You accept the inherent security risks of providing information and dealing online over the Internet and will not hold us responsible for any breach of security unless this is due to our negligence.

 

  1. Intellectual Property Rights

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all materials and/or content made available as part of your use of this website shall remain at all times our property. We do not give any implied licence for the use of the contents of this website.

You acknowledge and agree that the material and content contained within this website is made available for your personal non-commercial use only and that you may only download such material and content for the purpose of using this website. You further acknowledge that any other use of content of this website is strictly prohibited and you agree not to infringe or enable others to infringe our intellectual property.

 


 

  1. Consumer Protection (Distance Selling) Regulations 2000

You have a right to cancel your order within seven business days following the day after the date of delivery of your goods purchased via a transaction with us, for any unused item purchased through our website under the distance selling regulations for a refund. This does not apply to products or parts or items personalised or made to your specification. 
  2. Should you wish to cancel any order, you can e-mail, fax or write to us quoting your order number. All goods are returned at your own expense unless the item is deemed faulty and our warranty under clause 8 applies,  in which case we will refund the cost on receipt of the goods.
  3. Providing the goods are received back in an unused condition and in their original packaging with all accessories, you will receive a refund within thirty business days of receipt of the goods by us.

 

  1. Third Party Rights

 

  1. The Contracts (Rights of Third Parties) Act 1999 will not apply to this Agreement and no person other than the Parties will have any rights under it. The terms of this Agreement may be varied, amended or modified or this Agreement may be suspended, cancelled or terminated by agreement in writing between the Parties or this Agreement may be rescinded (in each case),without the consent of any third party.

  2. We do not accept any responsibility for any loss which may arise from accessing or reliance on the information on this site and to the fullest extent permitted by English law, we exclude all liability for loss or damages direct or indirect arising from use of this site.

 

  1. Waste and Electronic Equipment Directive

 

  1. Electrical and Electronic Equipment is one of the fastest growing waste streams in the UK, increasing by at least 5% each year. The public dispose of over 1.2 million tonnes of waste every year in the UK, and landfill sites are now reaching full capacity. Much of this waste can be recycled, and the resources recovered to make new consumer goods. The WEEE regulations aim to reduce the quantity of electrical and electronic items disposed of in this way, and will encourage everyone to play a part in protecting our environment for future generations.
  2. Under the WEEE Regulations, all new electrical goods should now be marked with the crossed-out wheeled bin symbol. Goods are marked with this symbol to show that they were produced after 13th August 2005, and should be disposed of separately from normal household waste so that they can be recycled.
  3. We are obliged under these regulations to offer our customers free take-back of their WEEE items on a like-for-like basis when they buy a new Electrical or Electronic Product from us. For example, if a you bought a new Electric Guitar from us, we would accept your old electric guitar and prevent it going into a landfill site by disposing of it safely. You must return your WEEE item to us (at your own expense) within one calendar month of purchasing the new item.
